No.36012/45/2005-Estt. (Res.)

Government of India

Ministry of Personnel, Public Grievances and Pensions

Department of Personnel and Training North Block

New Delhi- 110001.

Dated the 10th August, 2010

OFFICE MEMORANDUM
Subject: Reservation in promotion Treatment of SC/ST candidates promoted on their own merit.

The undersigned is directed to refer to this Departments O.M.No.36028/17/2001-Estt. (Res.) dated 11th July, 2002 which clarified that SC/ST candidates appointed by promotion on their own merit and not owing to reservation or relaxation of qualifications will be adjusted against un-reserved points of the reservation roster and not against reserved points. It was subsequently clarified by this Department's O.M. No.36028/17/2001-Estt. (Res.) dated 31.1 .2005 that the above referred O.M. took effect from 11.07.2002 and that concept of own merit did not apply to the promotions made by non-selection method.

2. Central Administration Tribunal, Madras Bench in O.A. No.900/2005 [S. KaÌugasalamoorthy v/s. Union of India & Others] has set aside the O.M. No.36028/17/2001-Estt. (Res.) dated 31.1.2005 and held that when a person is selected on the basis of his own seniority, the scope of considering and counting him against quota reserved for SCs does not arise. The High Court of judicature at Madras in the matter of UO1 v/s.S. Kalugasalamoorthy [WP No.15926/2007) has upheld the decision of the Central Administrative Tribunal.

3. The matter has been examined in the light of the above referred judgments and it has been decided to with draw O.M. No. 36028/17/2001-Estt. (Res.) dated 31.1.2005 referred to above. It s clarified that SC/ST candidates appointed by promotion on their own merit and seniority and not owing to reservation or relaxation of qualifications will be adjusted against unreserved points of reservation roster, irrespective of the fact whether the promotion is made by selection method or non-selection method. These orders will take effect from 2.7.1997. the date on which post based reservation was introduced.

4. These instructions may he brought to the notice of all concerned.

No. AIAIPASP/12/2011 dated at Salem 636 001 the 19.10.2011.

Respected Madam,

Sub :    Request to cancel the “modified massive transfer” orders
issued to the ASPs by the PMG in Central Region - reg

Ref :     i.   PMG, CR memo No. STA/101-07/2011/TR dated 30.09.2011.
            ii.  CPMG’s letter No. STA/2-7/2011 dated 14.10.2011.

1.         Before going deep in to our grievances, I, being the Circle Secretary of this Association would like to convey my heartfelt thanks - on behalf of my members - to our CPMG madam for having intervened and issued, not only humanitarian but also justified instructions (vide letter cited under reference - ii above) to the PMG, CR to cancel the massive transfer orders issued to eight of our ASPs. But……

2.         I would like to bring the following few points to our benign CPMG madam’s consideration before deciding the injustice done to our IP/ASPs in CR, by the PMG, CR.

i.                     On 30.09.2011 a “massive transfer” order was issued by the PMG, CR, transferring our members in the middle of the year which totally disturbed, not only their domestic life but also official life.
ii.                   On hearing this “massive transfer” orders, the Circle Secretary and few office bearers met the PMG, CR on 03.10.2011.
iii.                  But, even after a lengthy discussion & requests, the PMG, CR was not inclined to our request to cancel or defer this “massive transfer” orders.
iv.                 However, the PMG, CR had asked the office bearers to advise our affected members to send their request to the nearest vacant place within a weeks time and the PMG had assured to consider such requests.
v.                  On the assurance given by PMG, CR, few of our affected members had also submitted their requests to some nearest vacant places.
3.         But, the PMG, CR deviating from his assurance given to the office bearers of this Association on 03.10.2011, had issued directions to the Divisional heads (through eMail) and forcibly (under threat) relieved few of our members on 10.10.2011. As we had no other way left and as a last resort, met our CPMG Madam on 13.10.2011 and Madam had also patiently heard our grievances and issued instructions to the PMG, CR, as assured to us.

4.         It is learnt that our CPMG Madam had issued instructions to PMG, CR, vide letter cited under reference - ii above, to cancel the “massive transfer” orders by pointing out that:

i.                     this “massive transfer” orders is unwarranted in the middle of the academic year,
ii.                   this “massive transfer” orders is quite un necessary
iii.                  etc…etc.

5.         This Association and the affected members were eagerly expecting a positive response from the PMG, CR. But, in contrary, the PMG, CR instead of cancelling the “massive transfer” orders, had modified it and issued fresh transfer orders based on the subsequent requests given by the affected members, which is really a great shock to this Association & to our affected members. The IPs who have been promoted on adhoc basis are also compelled to be relieved and directed to join as ASP, where the regular ASP is disturbed and moved out.

6.         i. This Association is not able to understand why this massive transfer orders have been issued to eight ASPs by the PMG, Central Region - in the interest of service - along with adhoc postings, when there are many ASP vacancies to accommodate the IPs

ii. Even after instructions issued to cancel the “massive transfer” orders from our CPMG madam, why it is still insisted by the PMG, CR? When it has been instructed to cancel the “massive transfer” orders by the CPMG Madam, in toto, then the question of modified transfer on the strength of their subsequent requests does not arise.

7.         The Department is going on the way to convert it into a dynamic organization with projects like changing ambience of the offices, providing good working environment to the staff, providing comfort to the potential customers and various long lasting projects like Digitization of records, core banking, mail optimization, consumer prize index, Aadhaar Technology, Biometric systems etc., etc… All these projects are being implemented with the support and incessant hard work of this cadre. Thus, it will not be wrong to say that the major part of the responsibility for successful implementation of these various innovative schemes has virtually devolved on our cadre. Even after acquiring long years of service & experience & expertise, we are being mentally & physically disturbed by such massive transfers or for some or other reasons.

8.         Hence this Association kindly request the benign Chief PMG Madam to once again intervene and issue instructions to cancel the “modified transfer orders” issued by the PMG, Central Region, in toto. The IPs/ASPs who had already been relieved by force or by threat may be permitted to join their original places, by treating the period of transit as eligible leave.

9.         Further this Association requests the benign Chief PMG Madam to consider the requests of the IPs who have been ordered adhoc promotions and fresh adhoc posting orders may be issued to them to render better service.

 With regards.

ATMs in India Post

India Post's plan to set up automated teller machines (ATMs) in its post offices may fail to impress the banking regulator.India Post is in talks with the Reserve Bank of India (RBI) to set up ATMs. However, since according to norms, only banks are allowed to set up ATMs, the

central bank is not in favour of allowing India Post to set up ATMs. According to sources in the banking industry, if India Post set up ATMs, they should fall under the RBI's purview for regulation purposes.India Post has proposed to set up a subsidiary, Post Bank of India, for providing banking facilities. It has also identified nearly 1,000 post offices, out of its 1.5 lakh post offices, where the ATMs would be initially set up.The sources said though RBI is uncomfortable with the idea of India Post setting up ATMs, it is yet to formally communicate its apprehensions to the department of post.To increase efficiency and profitability, the department of post had planned to introduce banking solutions and set up ATMs and debit cards for its customers. It also plans to introduce core banking solution by 2012, and has initiated the process of modernising information technology (IT) during the current financial year. The cost of the IT modernisation project is estimated at around Rs 2,000 crore, which includes an integrated, modular software solution, covering postal operations, banking and insurance services. The department of post also has plans to tie up with banks to help its customers use their India Post debit cards at ATM machines. It has also submitted a plan to the finance ministry for approval. The department aims to offer banking services through India Post in unbanked rural areas that lack formal financing facilities.India Post already offers financial services, including post office savings schemes, postal life insurance, pension payments and money transfer services.

central region issues

Posted: 14 Oct 2011 09:40 AM PDT

Yes, our pathetic voices….really….reached our benign Chief PMG Madam.

It is ascertained from reliable sources that the brutal & massive transfer orders issued to eight of our ASPs in Central Region, Tiruchirapalli (TN), by its PMG has been cancelled by our beloved, benign Chief PMG Madam, today. This would not have been possible, but for the support & solidarity shown by our members, not only from us, but also from other sister unions.

This Association does not want to discuss in depth, the positive reaction of our Chief PMG to the negative action of PMG, CR….….which is not our concern. But this Association always assures the Administration that we are not against the policies, targets etc., etc. but we will also fight for our right.

This Association thanks the PMG, Central Region for having given us an opportunity to show our solidarity.

This Association also takes this opportunity to thank Shri.K.V.Sridharan, the General Secretary of AIPEU, Group C (CHQ) and Shri.J.Ramamurthy, CS of AIPEU, Group C, Tamil Nadu Circle for extending their support to us. We will also reciprocate…..whenever needed.

Here, it may not be wrong to say, that the TN Circle Branch of this Association is not able to understand the reasons for the non reaction of our GS (CHQ) in this issue. This cannot be ignored as an issue relates to a particular Region or a Region in a particular Circle. The CHQ should remember that it is a massive attack on our Cadre. If there is no reaction to this issue then for what else our CHQ is going to fight..?

MNOP Committee - Dissent Note submitted by staff side

NATIONAL FEDERATION OF POSTAL EMPLOYEES

1st Floor, North Avenue Post office, New Delhi – 110001
FEDERATION OF NATIONAL POSTAL ORGANISATIONS
T-24, Atul Grove Road, New Delhi - 110001

Ref: No. MNOP/GENL/2011 Dated – 11.10.2011
To,
Mrs. Manjula Parashar
Member (Operations)
Postal Service Board
Dak Bhawan, New Delhi – 110001
Madam,
Sub: - MNOP Committee Meeting
Kindly recall the discussion we had with you in the MNOP Committee meeting held on 10.10.2011
As already pointed out by us the minutes of the last meeting do not correctly reflect the view points expressed by the staff side representatives. We have neither agreed with the concept of new sorting hubs for speed post operations nor appreciated the concept for network redesign for first class mails. Our request for change of administrative control of all speed post hubs to RMS Superintendents and also our apprehension regarding closure/merger of sorting offices, especially in the metro/big cities in the wake of implementation of L1, L2 concept was also not included in the minutes. We are rather disappointed to note that inspite of our repeated request the Mckinsey consultancy’s full recommendations are not made available to us.
Regarding the discussion held on 10.10.2011, we had examined in detail all the pros and cons of the suggestions and assurances given by the administration in the meeting. We did not find any reason to change the stand taken by us as regards to implementation of first class mails hub i.e., L1 & L2. We have unanimously decided to oppose the implementation of the L1, L2 on the following counts.
1. It will definitely cause delay to the public mails as compared to the position prevailing now. We are not against improving the quality of the mail operations but it should not be at the cost of efficiency of the Postal Services.
2. Whatever may be the assurances given by the administration, the implementation of L1, L2 concept will result in closure/merger of sorting offices and divisions in the metros in the near future and at other stations at later date.
3. There will be large scale dislocation of staff and their carrier prospects will be adversely affected.
4. We further strongly feel that the international experience in the postal sector, after implementation of such recommendations, have proved disastrous and we don’t want that to happen in India Post by implementing the Mail Network Optimisation Project recommended by Mckinsey.
Finally we once against request you to desist from implementing the MNOP for first class mails i.e. L1, L2
Yours faithfully,
Sd/-

Steve Jobs

Steve Jobs, whose death was announced on Wednesday night, wasn't a computer scientist. He had no training as a hardware engineer or an industrial designer. The businesses that Apple entered under his leadership — from personal computers to MP3 players to smartphones — all existed before the company got there.
But with astonishing regularity, Jobs did something that few people accomplish even once: he reinvented entire industries. He did it with ones that were new, like PCs, and he did it with ones that were old, such as music. And his pace only accelerated over the years.
He was the most celebrated, successful business executive of his generation, yet he flouted many basic tenets of business wisdom. (Like his hero and soulmate, Polaroid founder Edwin Land, he refused to conduct focus groups and other research that might tell him what his customers wanted.) In his many public appearances as the head of a large public corporation, he rarely sounded like one. He introduced the first Macintosh by quoting Bob Dylan, and took to saying that Apple sat "at the intersection of the liberal arts and technology."

MINUTES OF THE MEETING OF THE COMMITTEE CONSTITUTED TO LOOK INTO ISSUES RELATING TO MAIL NETWORK OPTIMIZATION PROJECT
In accordance with the instructions issued vide Directorate memo No.08/9/2011-SR dated 12.7.11, the Committee constituted to look into issues relating to Mail Network Optimization Project met on 27.09.11. The meeting was attended by the following:
(i) Ms. Manjula Prasher, Member (Operations)

(ii) Ms. Shanthi S. Nair, CPMG, TN Circle

(iii) Shri Rishikesh, Director (Mail Management)
(iv) Shri M. Krishnan, Secretary General (NFPE)
(v) Shri D. Theagarajan, Secretary General (FNPO)

2. The terms of reference of the Committee were as follows:-

"The Committee will review the mail arrangement made as sequel to creation of Speed Post Hubs which, as represented by Staff Side, are causing delay as compared to the position prevailing earlier. The committee will also review the formation of L-1 and L-II in regard to First Class Mail".

3. Member (Operations) apprised the representatives of the staff side on the initiatives taken as part of Mail Network Optimization Project to improve the quality of Speed Post operations. She also stated that improvement in quality of mail related services was the key objective of the project, and hence, the staff side should fully cooperate with the administration in this endeavour. She further informed that cases relating to delay and back-routing of mail in certain areas have been reviewed and necessary action is being taken. For this purpose, mail arrangements have already been revised in case of HP, Haryana, Punjab, UP, Uttarakhand and AP Circles. Cases relating to other Circles are also being examined.

4. It was informed that instances of delay and back-routing of mail relating to Speed Post operations brought to the notice by the staff side are being looked into and necessary action is being taken for revision in existing mail arrangements wherever necessary. The staff side was also requested to give concrete suggestions on any particular area where improvement is needed. These suggestions would be sent by the staff side within a week. The staff side also agreed with the concept of new sorting hubs for Speed Post operations and opined that at best, a few more intra-Circle Speed Post hubs might be required to strengthen the operational network.

5. The features of performance monitoring tool, such as Key Performance Indicators (KPIs) website and analysis of performance of the Circles through video conference were explained in detail to the staff side. The staff side appreciated the efforts made in this area.

6. Member (Operations) informed that implementation of the network redesign concept for First and Second Class mail was equally crucial. The proposed network redesign seeks to minimize fragmentation in the processing of mail across the existing network, streamline processes followed in the mail offices, provide new tools and equipments for use in mail offices and put in place a technology-enabled environment for mail operations.

7. The staff side demanded copies of the reports submitted by the Consultants on restructuring of Speed Post and First Class mail network. It was agreed that relevant sections of the reports pertaining to operational restructuring would be provided to the staff side.

8. The staff side agreed and appreciated the concept for network redesign for First Class mail. However, they expressed their apprehensions about transfers of the staff concerned in near future.
