PART-A.

1) Concrete measures to contain price rise

2) Concrete measures for linkage of employment protection with the concession/incentive package offered to the entrepreneurs,

5) Creation of a National Social Security Fund with adequate resources in line with the recommendation, of NCEUS and Parliamentary Standing Committees on Labour, Stoppage of disinvestment in Central and State PSUs, the Central Trade Unions also demand immediate action by the Govt. of India to en sure:-

6) No Contractorisatlon of work of permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the Industry/establishment

7) Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs 10,000/-,

8) Remove the ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.

9) Scrap PFRDA Bill/New Pension Scheme; Ensure pension for all.

10) Compulsory registration of trade unions within a period of 45 days and immediate ratification of ILO conventions 67 and 96.

1. Stop downsizing, outsourcing, contractorisation, coporatorisation and privatization of Governmental functions

2. Fill up all vacant posts and create posts on functional requirements

3. Revise wages of CGEs with effect from 1.1.2011 and every five years thereafter.

4. Regularize the GDS, daily rated workers, contingent and casual workers by brining about a definite scheme of regularization.

5. Remove restriction imposed on compassionate appointment ( end the discrimination on compassionate appointment between the Railway workers and other CGEs)

  1. Stop the move to introduce the productivity linked wage system; Performance related pay; introduce PLB to in all Departments; remove the ceiling of emoluments for bonus computation.
  2. Settle all items of anomalies (including the MACP related anomalies) raised in the National and Departmental Anomaly committees within a fixed time frame of two months; set up the anomaly committees in those Departments where it has not been set up till date with the Standing Committee members of the National Council; convene the meeting of the Departmental Council in all Ministries/Department once in three month as envisaged in the JCM Scheme
  3. Make the right to strike a legal right and stop curtailment of T.U. rights
  4. Implement all arbitration awards
  5. Raise the interest rate for GPF. Revise the OTA and Night duty allowance and stitching and clothing rates of uniforms
  6. Merge DA with Pay for all purposes including pension as and when the DA rates croses the 50% mark.
  7. Vacate all Trade Union victimizations.

Vodafone need not pay Rs.11,000 crore Income Tax

Vodafone need not pay Rs.11,000 crore Income Tax -Supreme Court.

Supreme Court has bailed out Vodafone from paying Rs. 11,000 crore Income Tax, stating that the Government has no right to levy income tax on foreign companies for their international deals. The court also ordered that the Rs.2500 crore already paid by the company be returned with 4% interest within 2 months. The Supreme court issued this order on an appeal filed by Vodafone against the order of Bombay High Court asking the company to pay the Rs.11,000 crore income tax.

MEMORANDUM PRESENTED BEFORE THE PARLIAMENTARY STANDING COMMITTEE ON 19.01.2012

On behalf of the All India Postal Employees union, Group ‘C’, Tamilnadu Postal Circle, we put forth the following service as well as staff matters before the Parliamentary Standing Committee, for their kind perusal and for taking further action at appropriate level.

1. CLOSURE OF POST OFFICES RESULTING IN HAMPERING OF PUBLIC SERVICES

A.Of late there is unmindful closure of Post Offices in large number, throughout Tamilnadu State , affecting public services badly. This results in receiving severe criticism from public end against the Postal Department, and encouraging to flourish the private couriers. When staff unions are raising up this matter, the Circle administration is replying with one reason or the other to justify their stand. Some of the reasons furnished by the administration are

a. The rented building is in damaged condition.
b. The rented building is in the Court orders for vacation.

For these reasons , though alternate buildings are secured by the service Unions for rental, the proposals are badly delayed months together by the Fair Rent Action Committee, without valid reasons. Also the rent so fixed is not in consonance with the prevailing market rates . This results in losing the offers given by the private owners, resulting in permanent closure of the said P.O.s so closed.

c. The Post office is either loss making or not with viable transactions .

For this, the suggestion given by the service unions for re-locating the P.O. into the needy extension areas within the Divisional periphery , is not taken into consideration by the Circle administration.

d. There are several Post Offices functioning within 5 km. radial distance.

These Post Offices are opened based on the needs of the common public, based on the density of population in these areas. Now-a-days trend of the Administration is against this concept.
B. Lack of basic amenities in Post Offices:-
There is lack of basic amenities such as poor maintenance of toilets, damaged pipe lines, Lack of water facilities , shabby wash basins are the order of the day in the P.O. premises . The working staff are suffering much in unhygienic atmosphere. This area may also kindly be looked into.

Note: The list of Post offices closed at the recent past in Chennai City is annexed at the end.
2. OPENING OF POST OFFICES ON SUNDAYS AND HOLIDAYS BY DRAWING THE REGULAR STAFF FOR DUTY CONTINUOUSLY WHICH IS AGAINST HUMANITARIAN GROUNDS AND I.L.O. NORMS.

In Tamilnadu Postal Circle the staff are ordered to open Post Offices on all the holidays and Sundays without gap and to perform the multipurpose counter transactions, delivery of speed post articles and dispatch of mails. The staff are rotated within themselves, and their off duty in week days have to be attended to by the others. Thus all the staff are compelled to work in all the holidays and working days , which is totally inhuman. Also the traffic on these days are very low . Further , when compared with the income so realized, the expenditure made by means of electricity, maintenance , management are too high and is loss making to the Department. This may be stopped in the interest of staff as well as the Department.

3. UNMINDFUL INTRODUCTION OF MARKETING OF CONSUMER GOODS IN P.O.s

The Postal Department is rendering the basic services of mails and Savings Bank activities, Money Orders etc. both in the interest of common public and the Department, outstandingly for the past 150 years. This image and service oriented activities are now shattered, by introducing the selling of consumer products like Refrigerator, Watches, cell phone re-charge cards, gold coin sales, sale of tamil magazines etc. etc. of private producers on agency basis for meager commission. The private companies are en-cashing the traditional image of the age old Government Department for their sales. Also,there is no considerable benefit to the Department, when calculated with the income and cost factors. Even local level officers are undertaking agency works unmindfully on petty products and the Govt. employees are forced to work as marketing agents of the private companies. This may be stopped immediately and basic services have to be improved in order to save the image of the Department and to cater the public needs with profit base.

4. MANAGING OF SHORTAGE OF STAFF AND NON FILLING OF VACANT POSTS

There is abnormal shortage of staff in P.A., Postman/MTS cadre against the sanctioned strength of posts, resulting in hampering of day to day duties in all the areas. This affects the public services badly. There is irregular assessment of vacancies for long and the posts were not filled up proportionately according to norms. Even the engagement of daily wage outsiders on vacant posts in the name of outsourcing are abruptly stopped now,
without any reason. This further aggravates the situation. The delivery work is also much affected and the field staff are compelled to combine the delivery duties beyond their norms and extended mileage. This also badly affects the public service. Action is much requested to fill up all the vacancies with proper assessment of previous years vacancies also. Till such time engagement of daily waged outsiders (outsourcing) may be permitted as in the case of past, in order to render the services effectively and smoothly.

5. DEVELOPMENT OF INSURANCE SECTOR IN POST OFFICES

Presently the Postal Department is undertaking Insurance business in the name of Postal Life Insurance and Rural Postal Life Insurance. The rural level staff , especially the poor waged Gramin Dak Sevaks are tortured by the officers to achieve the fake targets and compelled to pay the first premium from their own pocket. This fact is proved beyond doubt that the number of policies so secured in a financial year is not matched with the premium amount so collected on monthly basis. This kind of attitude should be curbed.
In order to improve the business of PLI and RPLI, adequate Development Officers may be appointed at all Divisional level exclusively for this purpose, with separate staff structure at all levels, in order to improve the business and after sale service properly.

6. RESTORATION OF SPEED POST TRANSMISSION SYSTEM

Recently the Department has taken a stand to create speed post Hubs, Region wise and centralized the sorting of speed post articles from the hubs. This results in multiple handling of speed post articles in circuitous route and resulting in abnormal delay of delivery of speed post articles. It invites severe criticism from the public and media as ‘ slow post’. Earlier , the speed post articles are dispatched from the booking end , directly to the destination end by closing direct bags. This paves way in speedy delivery of the articles. Hence closing of direct bags from the booking end to the destination end may be ensured as in the case of past, for development of speed post business and to restore the public confident with the Department.

6. REGULARISATION OF CASUAL LABOURERS

The casual labourers engaged in the Department for more than 15 to 20 years are working against various posts such as Postman, MTS and GDS and their services are not regularized till time , even though assurances were given by the Department to safe guard their services. Hence dovetailed list may be prepared Division wise to maintain their seniority and they may be given chances in their turn in filling up the vacant posts on regular basis.

10-points charter of demands :28TH FEB 2012 STRIKE

HISTORIC DECISION OF THE CENTRAL JCA : UNITED STRIKE ON 28th FEBRUARY

Simultaneous with the decision of calling off the indefinite Postal Strike, the Central JCA has taken and announced another decision --- to join the 28th February 2012 strike called by all recognised Central Trade Unions for the first time in India. It would not be an exaggeration if we call this decision HISTORIC. The JCA leadership has responded to the call of the soul of the Postal workers and identified the need of the time.

Please recall the strike of 1946, when Postal employees proceeded to strike against the British imperialism. The fate of the common people is no better now, apart from the fact that the exploitation and corruption is now coming from people rooted in our soil. We may have a look to the 10-points charter of demands :

  1. Concrete measures to contain price rise

These are all about social rights, right for employment & living with minimum honour, protection for the workers, ensuring social security. We are also experiencing same bureaucratic attack on our professional lives. Let us campaign wholeheartedly to make the 28th Feb strike a landmark in the Trade Union Movement of our country so that we can make the Govt scrap the neo-liberal anti-labour policies by the dictate of capitalists.

Thousands of 'Occupy Wall Street' protestors demonstrated in front of White House, the office of the United States Government in Washington continuing their protests against inequality, unemployment and other issues on which they had been continuing their agitation. It is also reported that in between, a smoke bomb was hurled at the white house by unknown people.
The US government has so far kept silence on the incidents.

for a worker-oriented budget 2012

The Central Trade unions today met the Finance Minister today, 16th January and demanded for a worker-oriented budget aimed at generating employment opportunities and removing poverty.


In their customary pre-budget meeting with Finance Minister Pranab Mukherjee, the representatives of trade unions suggested the government should come out with more social security initiatives and take steps to strengthen public sector undertakings.

National Trade Unions CITU, AITUC, BMS, INTUC, HMS, AIUTUC, AICCTU, UTUC, TUCC, LPF and SEWA- submitted the following memorandum for the pre-budget consultation.

Sir,

We thank you for inviting the Central Trade Union Organisations for the pre-budget consultations. We hope that our suggestions will be taken up with all seriousness and will find appropriate reflection in the forthcoming budget.

We are seriously concerned about the situation of the country’s economy in the present global scenario. We are afraid the seriousness has not been truly reflected in the note on “State of Indian Economy”, sent by MOF to us. In the midst of acute agrarian distress, unacceptable levels of inflation leading to sky rocketing prices, huge job losses, mounting unemployment, there is an urgent need to revisit these areas of concern which has been glossed over in the note. For example the note deals with GDP growth since 2005 in two and half pages without mentioning a word about employment growth during this period. For a proper assessment of actual impact of the economic growth on the people, the employment data should be released every quarter along with estimate of GDP which will show how most of the gains of GDP growth is being wholly appropriated by the employers/investors leaving common masses high and dry. We urge upon you to initiate suitable mechanism to bring in public domain the actual linkage of employment growth with GDP growth for realistic assessment of the state of economy.



We further urge that the coming budget should be people-oriented addressing the issues of poverty, unemployment and social infrastructure. We place here our specific proposals with this end in view.

• Take effective measures to arrest the spiraling price rise and contain inflation; Ban speculative forward trading in commodities; Universalise and strengthen the Public Distribution System; Rationalise the tax/duty/cess on petroleum products as a part of anti inflationary measure.

• In view of huge job losses and mounting unemployment problem, the ban on recruitment in Govt deptts., PSUs and autonomous institutions should be lifted as recommended by 43rd Session of Indian Labour Conference (ILC).

• All stimulus packages to the corporates must be made conditional to ban retrenchment, VRS, lay-off, closures, wage-cut etc. and to create employment.

• The massive workforce engaged in ICDS, Mid-day meal scheme, Vidya volunteers, Guest Teachers, Siksha Mitra etc. be regularised and the workers engaged in the Accredited Social Health Activities (ASHA) are brought under the coverage of statutory minimum wage and social security. Universalisation of ICDS be done as per Supreme Court directions by making adequate budgetary allocations.

• The scope of MGNREGA be extended to urban areas as well and employment for minimum period of 200 days with guaranteed statutory wage is provided, as unanimously recommended by 43rd Session of ILC.

• Steps are taken for removal of all restrictive provisions based on poverty line in respect of eligibility coverage of the schemes under the Unorganised Workers Social Security Act 2008 and allocation of adequate resources for the National Fund for Unorganised Worker (as fixed percentage of GDP) to provide for Social Security to 43.5 crore unorganized sector workers including the contract/casual and migrant workers in line with the recommendations of Parliamentary Standing Committee on Labour and also the 43rd Session of ILC.

• Public investment must be increased for creation of assets and decent employment. For the purpose, the public sector units should be strengthened and expanded. Disinvestment of shares of public sector units should be stopped forthwith and their huge reserve and surplus of more than Rs. 6 lakh crore be used for rehabilitation of sick CPSUs and modernization and expansion of other CPSUs. CPSUs are having average debt equity ratio of 0.75:1 as compared to 2.3:1 in private sector, PSUs should be allowed to have more access to debt market of banks and FIs instead of resource mobilization in equity market through disinvestment

• The financial sector, including Banks & Insurance which stood the test of time even during the recent global melt down should be encouraged, enlarged and improved instead of imposing the so called reforms which will adversely affect them and weaken their public sector character. The proposed move of Banking and Insurance and Pension Reforms to be stopped forthwith. Industrial houses should not be permitted to start banking operations.

• Requisite budgetary support for addressing crisis in traditional sectors like Jute, Textiles, Plantation, Handloom and Coir etc.

• Budgetary provision for elementary education should be increased, particularly in the context of the implementation of the right to education as this is the most effective tool to combat child labour.

• Ongoing export of raw materials/mineral resources should be restricted and strictly monitored either directly or through appropriate fiscal instrument to promote value addition and consequent employment generation domestically. In particular, iron-ore export should be banned and domestic steel makers should be allotted captive blocks on a preferential basis.

• The system of computation of Consumer Price Index should be reviewed as the present index is causing heavy financial losses to the workers. The revision of DA should of done every three months instead of six months.

• EPF rate on interest to be enhanced in view of high inflation and as a part of social security. Threshold limit of 20 employees in EPF Scheme be brought down to 10 as recommended by CBT-EPF. Pension benefits under EPS unilaterally curtailed by the Govt. should be restored. Govt. and Employers’ contribution be increased to allow sustainability of Employees Pension Scheme and for provision of reasonable minimum pension as recommended by Parliamentary Standing Committee on Labour. The interest rate on SDS (Special Deposit Scheme) be raised to 9.5% to begin with.

• Assured Pension for all

• Universal coverage of all employments under Minimum Wage Act and fixation of statutory minimum wage not less than Rs 10,000/- per month with indexation

• Removal all ceilings on payment and eligibility of Bonus, Provident Fund; Increasing the quantum of gratuity.

• No Contractorisation and outsourcing of work of permanent / perennial nature. Till the contractorisation is abolished payment of wages and benefits to such workers at the same rate as available to the regular workers of the industry/establishment

• Income Tax exemption ceiling for the salaried persons should be raised Rs. 3 lakh per annum and fringe benefits like housing, medical and educational facilities should be exempted from the income tax net in totality.

• Entry of MNCs and big corporate in retail trade be prohibited.

ON RESOURCE MOBILISATION and TAXATION, we propose the following

• Increase duty on imported power plant equipments

• Impose windfall tax on petroleum products exported from standalone refineries to curb their windfall profits.

• A progressive taxation system should be put in place to ensure taxing the rich and the affluent sections who have the capacity to pay at a higher degree. The corporate service sector, traders, wholesale business, private hospitals and institutions etc. should be brought under broader & higher tax net. Increase taxes on luxury goods and reduce indirect taxes on essential commodities as at present the overwhelming majority of the populations are subjected to Indirect taxes that constitute 86% of the revenue.

• Increase export duty on ongoing iron ore export

• Concrete steps must be taken to recover huge accumulated unpaid tax arrears which has already crossed around Rs 3 lakh crore on direct and corporate tax account alone, and has been increasing at a geometric proportion. Such huge tax-evasion over and above the liberal tax concessions of around Rs 2 lakh crore on direct and corporate tax account as on 2009-10, should not be allowed to continue.

• Effective measures should be taken to unearth huge accumulation of black money in the economy including the huge unaccounted money in tax heavens abroad. This money should be directed towards providing social security.

• Concrete measures be expedited for recovering the NPAs of the banking system from the willfully defaulting corporate and business houses. Defaulters should not be allowed fresh loans.

• Tax on Long term capital gains to be introduced; so also higher taxes on the security transactions to be levied.

• ITES, outsourcing sector, Educational Institutions and Health Services etc. run on commercial basis should be brought under Service Tax net.

We hope, the suggestions made above will receive serious consideration. We also urge you to hold post budget discussion with trade unions as is held with the Corporate Association/Federations.

The attack on Postal and RMS Employees including Gramin Dak Sevaks is mainly due to the policy of the Government against which all the Central Trade unions and Federations are jointly fighting. We as Postal workers, it is our duty to join the working class in its fight against the anti-labour policies of the Government. The Central JCA (NFPE, FNPO, AIPEDEU, NUGDS) calls upon the entire Postal and RMS employees including Gramin Dak Sevaks to conduct intensive preparations for making the 28th February 2012 All India Strike a complete success. Strike notice will served by the Central JCA to the Secretary, Department of Posts.

OUTCOME OF STRIKE SETTLEMENT. PLEASE AWAIT FOR MORE DETAILS .


No closure of RMS for three years and
1. No one will be transferred to L1 or L2 unless they request so.
2. L1 sorting hub will be opened on requirement
3. APMC will not be opened further. No APMC for Chennai / Mumbai. Position will be decided after two years.
4. Speedpost hub will be under RMS.
5. There will be NO CLOSURE OF POST OFFICES. NO MERGER OF POSTOFFICES. RELOCATION OF UNVIABLE POSTOFFICE WILL BE DECIDED ONLY BY DIRECTORATE.
6. Group of Secretaries under CABINET SECRETARY accepts- Revision of OTA and GDS BONUS enhanced Limit Rs 3500/-
7. Postman Exam/ postman recruitment/MTS recruitment rules will be modified. Open market recruitment of 25% will be changed and maximum benefits to GDS.
8. Cash handling point for GDSBPM ( Existing one point for Rs 20000/- ) will be favourably finalized shortly.
9. Protection of TRCA will be ensured. Orders will be issued shortly.
10. GDS compassionate appointments---- will be modified suitably
11. GDS mail man will be redeployed suitably
12. Chapels will be supplied to GDS
13. GDS –cash conveyance allowance existing Rs 50/- per month will be changed to Rs 50/- per day. Suitable proposal will be sent.
14. Casual labour . Committee report already submitted . Decision will be made with in a week.
15. PO & RMS Accountant pay fixation will be decided favourably.
16. Restriction posting again to Single handed/ double handed post offices will be relaxed and Divisional head will decide case to case.
17. Un qualified accountant will also be granted Special Pay.
18. Fidelity bond for Treasurer and Single handed SPM will be abolished.
19. Clarificatory orders for Post attached quarters will be issued shortly.
20. Protection of pay for defunct accountant is agreed
21. New pension scheme statement will be given periodically
22. Enhanced Financial Powers for LSG/HSG II and HSG I will be notified with in a month.
23. Over payment cases against APM (Accounts ) will be considered on Humanitarian angle.
24. Revision of Honorarium- orders will be issued shortly.
25. Physically challenged officials will also be permitted for IPO exam
26. Cash handling allowance at enhanced rate for TREASURERS will be examined
27. MACP I/II/III officials will also be eligible for Treasury / Accountant allowances
28. Next JCM Departmental council meeting is to be conducted in Feb 2012
29. All Circle heads will conduct RJCM with in due Period .
30. Monthly /Bimonthly / Four monthly meetings will be conducted in due time
31. Cadre Restructuring with in 31/3/2012
32. Another committee will be constituted for MMS Drivers
33. PLI/RPLI work will be under taken at RO/CO for the town divisions where RO/CO is situated
34. Honorarium for PLI/RPLI work will be given
35. All GDS posts will be filled shortly
36. Postmaster cadre officials will also be permitted to officiate HSG I/HSG II Postmasters
37. Postmaster cadre officials will also be permitted to appear in IPO/Group B exam
38. PO & RMS Accountant will also be permitted for Postmaster Grade I exam
39. System Administrator---- conveyance allowance and Road mileage will be granted. Another committee will be formed for their Cadre Restructuring with in a month.
40. Trainer allowance will be given to System Administrators and WCTC trainers also.
41. New guidelines will be issued for SBCO staff RT and transfer
42. SB Minus balance cases –Our Staff side Proposals will be examined
43. Contributory negligence factor – Another instruction will be issued
44. PO& RMS Accountant – Special Hierarchical will be considered
45. Declination of promotion before 1/9/2008 - Granting of MACP in such cases - orders will be caused to be issued by DOPT
46. FR 17 A will not be issued for simple cases only deserves for Dies Non.

CENTRAL JCA MET ON 11.01.2012 UNANIMOUSLY DECIDES TO GO AHEAD WITH THE INDEFINITE STRIKE MAKE THE STRIKE CENT PERCENT SUCCESS

We are in receipt of encouraging reports from various circles and divisions about the mobilization by grass root level workers and leaders for the total participation of employees in the Indefinite Strike from 17th January 2012 as per the call of Central Joint council of Action (NFPE, FNPO & GDS Unions)

Inspite of our vehement opposition the Postal Board is adamant on implementing Mckinsey consultancy reforms (L1, L2) in RMS. Further regarding closure/merger of Post offices, they are violating the earlier assurances and going on justifying the merger of Post office. On other demands assurances given in July 2011 is repeated and no result oriented action is forth coming.

In these circumstances the Central JCA meeting held on 11.01.2012 has unanimously decided to intensify the strike preparations and go on indefinite strike from 17th January 2012.
