Dear Comrade
The Standing Committee of the Staff Side, National Council has interaction with the 7th CPC on 25th Feb. 2015 followed by the Standing Committee meeting of National Council (JCM) with the Secretary DOPT in the afternoon. The meeting with the Secretary Personnel came as a result of the decisions that we have conveyed for organizing March to Parliament and other programmes, culminate as a pre pretretory meaure for an indefinite strike. The agenda for discussion with the Secretary Personnel was, therefore, the charter of demands (10 points) we had submitted to the Government after the National Convention of all Central Government Employees Organizations on 11th December, 2014. The response from the Government undoubtedly establish the fact that ultimately they have taken note of the growing discontentment of the Central Government employees manifested through various programmes we have jointly carried out by this time. We, therefore, earnestly request the affiliates and leaders of various organizations at the field formations to intensify the ongoing programmes to compel the Government to settle our demands. We give hereunder a brief resume of the discussions we had with the Pay Commission and the Secretary Personnel, which is indicative of the reflections of both the entities.
Meeting with the Pay Commission:
The Chairman informed of his inability to take a final decision on the question of merger of DA and Interim relief as the Government has not referred this matter to them and further stated that this Govt. can take decisions on the two issues, without any report from the CPC. He added that the memoranda received from the staff Side on these two issues had been forwarded to the Government. He wanted the staff side to take up the matter with the Government and assured that on receipt of the reference from the Government they would consider the matter without any loss of time. However, they indicated that the Commission would strive to submit their report to the Government within the stipulated time frame and therefore, the question of Interim relief, in his opinion should not arise at all. The Staff side requested him to appreciate the fact that the matter concerning merger of DA and interim relief has been raised by them not on account of the possible delay on the part of the Pay Commission but emanated from the fact that the erosion in the real value of wages of the Central Government has been eroded during the period drastically.
On Oral Evidence:
The methodology to be adopted by the 7th CPC in the matter was discussed at length. It was ultimately decided that the Staff Side after considering the viewpoints expressed by the CPC will draw out a plan both for the National Council Staff Side and for the organizations at the Departmental levels. The scheduled date for meetings with the Pay Commission will be finalized after Holi festival i.e. 5th March, 2015. The Staff Side will discuss the matter and will submit its consensus view to the Commission soon in this regard. In any case, the staff side would require the following information immediately at its office.
1. Name of the organization which has submitted its memorandum to CPC with date of submission,
2. Underwhich Ministry the Department function
3. Whether the organization is recognized or not
4. The number of employees, whom the organization represents
5. The total – Group C and Group B Non Gazetted – strength of the concerned Department.
Inclusion of GDS
The Chairman assured that he would go thrcu1:1h the Supreme Court Judgment in the matter. However, fie added that the inclusion or otherwise of the GDS within the purview of the 7th CPC is the prerogative of the Government and except making its opinion clear on the subject he might not be able to do anything further in the matter.
Standing Committee meeting with Secretary Personnel: There had been no tangible result in the discussions. The impression gained was that the staff side was invited to show that the dialogue continues, However, we give here under the response of the Government in respect of the issues subjected for discussion. The rest of the issues in the charter will be discussed later on at another meeting, for which the date has not been indicated
1. Interim relief, Merger of DA, Date of effect, Inclusion of GDS in the ambit of 7th CPC; Settlement of anomalies:
The views expressed by the official on each of the above items are as under
a). Interim relief is normally given if there is an apprehension of abnormal delay. Government has been informed by the 7th CPC that they would adhere to the time schedule.
b).        DA merger: Since the Pay Commission would be submitting its report soon, the question of merger of DA would automatically be in-built in their recommendation.
c).        It is the prerogative of the CPC to recommend the date of effect.  Govt.’s role will come only after the recommendations are received.
d).        GDS:  Govt. has not considered the GDS as Civil Servants. However, the latest recommendation received from the Postal Department in the matter is said to be under the consideration of the Govt.
e).        The National Anomaly committee will meet again shortly and the resolution on agreed items would be expedited.
2. FDI and Privatization of Railways and Defense factories and Corporatization of Postal.
The Staff Side was advised to take up the issue at a higher level as the issues raised were said to be policy matters.
3. No ban on recruitment.
The official Side clarified that the Govt. has not instituted any ban on recruitment.  There is only ban on creation of posts. However, for operational posts, exemption has been provided in compelling situation.
4. Scrap PFRDA Act.
The official side will look into the letter received from the Railway and Defence Ministers. The scrapping of the Act was said to be not within the scope of discussion. The Joint Secretary Financial Services explained the various provisions of the Act and as to how the contributory pension scheme would be beneficial to the subscribers. The Staff Side requested the Government to make it optional that anybody who feels that the new scheme would be beneficial would opt for it and others will have the opportunity to opt out and adopt the old defined benefit scheme scheme of Pension.
5. Closure of Medical Stores Depots and Printing and Stationery Departments
It was categorically cleared by the Govt that there had been no decision to close down the Printing Presses and Stationery Department. In view of the new situation in which all Departments are permitted to purchase the requisite stationery items from the market, the Urban Development Ministry has suggested certain modernization and restructuring the of Stationery Department.  The Govt. was prepared to discuss the details thereof and arrive at an amicable settlement, acceptable to the Staff Side. The official side expressed willingness to discuss the matter with the staff Side of the concerned Department along with the 3 (three) members of the standing Committee. In respect of Medical store depots also, the official side clarified that the department would not be closed down and no employee will be retrenched. They also wanted the staff side to meet and discuss the issue with them to clear the doubts and suspicion in the matter.
6. Active Functioning of JCM
The Government will convene the meeting of the National Council soon. the convening of the Departmental Councils would be taken up with the concerned Departmental heads. The delay in the grant of recognition may be brought to the notice of the Department of Personnel for corrective action at their end
7. Compassionate Appointment
Government will consider lifting of the ceiling of 5% but no assurance was held out. The other issues in the charter will be subjected to discussion later on.

No Stopping of Fresh Appointments
Government of India has not issued any instructions on stopping of fresh appointments in Government.
Whenever the vacancy arises due to retirement etc., the same is required to be filled-up as per the provisions made in Recruitment Rules by the concerned Ministry / Department.
This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in Prime Minister’s office Dr. Jitendra Singh in a written reply to a question by Shri Vijay Jawaharlal Darda in the Rajya Sabha today.

The Central Government is reluctant to settle the justified and genuine demands of Central Government employees i.e. 100% D.A. merger, 25% Interim Relief, Inclusion of GDS in 7th CPC , Date of Effect 1.1.2014 , Scrapping of New Pension Scheme , filing up of vacant  posts, in all Department’s , withdrawal of contractrization  and out sourcing  policy, removal of 5% ceiling on compassionate  appointments, Removal of MACP related  anomalies , Revision of OTA Rates  including some other demands.

Joint Consultative Machinery which was formed for the redressal of grievances of Central Government Employees by negotiations has been made defunct and no meeting has been held after 2010. After constitution of 7th CPC the views of Staff Side N.C. JCM has not been taken into account. The Terms of Reference of 7th CPC were declared unilaterally and agreed draft of Terms of Reference submitted by Staff Side was not given cognizance. The Minister in P.M.O. Shri Jitendra Singh replied in response to the question raised by some MPs that Government is not going to grant 100% or 50%  D.A. Merger , 25%  Interim Relief and inclusion of GDS in 7th CPC.

In the back ground of all these developments a National Convention of all constituents of National Council JCM was convened in New Delhi on 11th December-2014. All the participants’ organizations vehemently opposed the policies of Central Government.

After detailed deliberations it was decided that a massive Parliament March will be organized in New Delhi on 28th April-2015 in which the date of Indefinite Strike will be declared. Intensive preparation campaign is going on. NJCA was formed at National level in which the top leaders of AIRF, NFIR, AIDEF, NDWF, Confederation, NFPE and FNPO are included. State JCAs have been formed in most of the circles and State conventions have also been held and wherever it has not been formed the state leadership has been asked to complete this work very soon.

It has been decided to mobilize 100000 one lakh Central Government Employees to participate in Parliament March. Quota has been fixed as 50000 for Railways, 30000 for Defence and 30000 for Confederation. Confederation has allotted quota to NFPE as 10000. Accordingly NFPE has also allotted quota to each affiliated union. Comrades, as we know that whatever we have achieved that is because of struggles only. The present government is functioning to give maximum benefit to the corporates and capitalists. It is not at all concerned about the working class. It started disinvestment in PSUs, Declared 100% FDI in Railway and 49 % FDI in Defence. The recommendations of Task Force Committee headed by TSR Subramaniam .are big danger for Deptt of Post which has paved the way of privatization through Corporatization.  

Confederation of C.G.E&W and NFPE have given separate programmes of agitation which should be observed with great enthusiasm.

NFPE calls upon the entire Postal, RMS  and GDS employees to make all the programmes a grand success and mobilize the maximum number employees, more than the quota allotted to each affiliated union to take part in  the Parliament March  on 28thApril-2015 on call of National Council JCM to make it a historic success.

Management of banks which are parties to the Bipartite settlement and
Workmen Unions and Officers Associations on wage revision
Discussions were held between the Indian Banks’Association representing Managements of banks and the authorized representatives of Workmen Unions and Officers Associations on wage revision for officers in banks. After holding several rounds of discussions, the parties have mutually agreed as under:
1. The wage revision will be effective from 1.11.2012
2. The annual wage increase in salary and allowances @ 15% which works out to Rs.4725 crores on salary slip components.
3. The new scales will be constructed after merging dearness allowance corresponding 4440 points as on November 2011, which works out to 60.15% and adding a load factor of 2% on Basic pay plus Dearness Allowance as on 31st March 2012 amounting to around Rs.597 crores.
4. Distribution of annual wage increase between workmen unions and Officers Associations will be worked separately based on breakup of establishment expenses as on 31-3-2012.
5. Every second and fourth Saturday of the month will be a holiday and the other Saturdays will be full working days.
6. All other issues of the Managements and Unions/Associations discussed during the process of negotiation will be settled to the mutual satisfaction.
7. The parties will meet on mutually convenient dated to draw out a detailed Bipartite Settlement/Joint Note on the various issues on which consensus positions have been reached. The parties will endeavour to finalise the Bipartite Settlement/Joint Note within a period of ninety days from the date of this minutes.

Delhi High Court has directed Central Administrative Tribunal, Principal Bench, New Delhi to list the GDS case filed by NFPE & AIPEU – GDS (NFPE) for next hearing on 18th March 2015. The High Court also directed that the file of this case should be made available to the Registrar, Central Administrative Tribunal on the above date fixed by High Court.

The meeting of the participating members in the study camp organized by the confederation of Central Government Employees & Workers at Bangalore unanimously resolved to urge the authorities of the Department of Atomic Energy and Indira Gandhi Centre for Atomic Research to revoke the suspension of 4 Office Bearers of NFAEE/AEEA with immediate effect and stop the move to derecognize the Atomic Energy Employees Association resigned under CCS (RSA) Rules 1993.

            The participants’ notes that the suspension was initiated against these leaders to leading the entire nuclear worker of the Kalpakkam on the attempt of the management is nothing but to suppress the trade union activities at Kalpakkam and the meeting condemn the attitude.

            The meeting of the participating members extend support and solidarity to the fighting comrades of the Kalpakkam.

            To express the solidarity with the victimised comrades the meeting has resolved to call upon all organisations attitude to confederation of Central Government Employees and workers, its branches and members throughout the country to held massive demonstration on 18th February 2015 and to pass resolution and send the same to The Secretary Department of Atomic Energy, AnushaletiBhavan, CSM Marg, Mumbai-400001.

NMC urges FM to raise IT exemption limit to 5Lakh and for Merger of DA

JAMMU: 
The National Mazdoor Conference today asked Union Finance Minister Arun Jaitley to raise the income tax exemption limit to Rs 5 lakh.
“We urged Union Finance Minister to raise the Income Tax exemption limit to Rs five lakh,” National Mazdoor Conference (NMC) President Subash Shastri said while addressing a series of rallies at Kanjali and Bomyal in Nagrota Block here today.
Shastri also appealed he Finance Minister to announce non inclusion of amount of DA to calculating income tax as the DA instalments are released by the government from time to time to utilise the impact of price rise and inflation.
Shastri emphasised the need for immediate merger of 50 per cent DA into basic pay and pension as per the recommendations of the Fourth Pay Commission.
He added that all these burning issues impacting both the Central and State Governments Employees and pensioners should be addressed by the Union Finance Minister while presenting the budget for 2015-16 in the coming Budget Session of Parliament beginning on 23rd of this month.
He also demanded immediate release two DA instalment of 17 per cent in favour of State Government Employees and pensioners, pointing out that while Central Government is about to release another instalment 6 per cent DA in favour of its employees and pensioners from Jammu 2015 but it is unfortunate that the salaried class in the state has not got the benefit previous two DA instalments.
He also demanded early regularisation of the 62,000 daily rated workers beside release of their wages without any further delay.

A MAN WHO SPENT 60 YEARS OF LIFE IN PUBLIC SERVICE IS NOT AMONG US TO GUIDE US IN FUTURE

Comrade S.K.Vyas – An unparalleled leader of five Decades!

It was in the year 1971 that I first met Comrade S.K.Vyas after one year of my recruitment in the Department of Posts. I was an office bearer in P4 NFPE Madras City North Division and wanted to organise a meeting when I came to know the visit of Comrade Vyasji in Madras. I was not even a Divisional Secretary but when I approached him for attending a meeting in Vepery Post Office, he readily agreed and attended. The simplicity and approachability of such a big leader inspired me in those days of my youth.

27 years later, I joined Comrade Vyas to work under one roof in D-7, Samru Place, Mandir Marg, New Delhi, where the NFPE headquarters was situated and Confederation Hqrs also was in the same premises. I joined there as Secretary of the Postal Federation. It was a nature given golden opportunity to live with such a towering leader under one roof. For a period of more than six years (intermittently of course) I had literally lived in the same premises and closely observed the qualities of this great leader. If I don’t admit that I have learnt many things from this leader then I am sure I am lying. At a particular point of time in the year 2004, when I was seriously ill, it was Comrade Vyasji who helped my admission in Sir Gangaram Hospital, which saved my life.

More than 40 years later, when I entered a Pensioners Organisation, it was again Comrade Vyas who is our leader. I have joined BCPC and NCCPA under his leadership when I became the General Convenor and later the General Secretary of AIPRPA. Thus from a small time office bearer of a branch union in 1971 to till date as an activist of a Pensioners Organisation, along with others I was always guided by this towering leader, whatever be the front we worked.

Therefore it is not possible to express in appropriate words about the demise of this legend yesterday in Jaipur.

Vyasji was admitted to hospital at Jaipur about 11 am on 1st February, one day before his 86th birthday after a massive heart attack. He underwent angio plasty immediately and all of us hoped that he is out of danger. But after a couple of days, he had another attack. His BP became unstable and thereafter intestine also got affected. On 13th February he suffered another heart attack – causing death.

Vyasji was the secretary general of all India audit & accounts association from 1969 to 1981 and thereafter it’s all India President up to 39th conference at Chennai in September 1989. Vyasji became the Secretary General of confederation when Comrade O.P.Gupta resigned after 1968 Strike. He continued as Secretary General of Confederation up to September 2006, after which he became President. He stepped down from all elected posts of Confederation in the Kolkata conference in 2013 but continued as Chief Advisor of the Confederation of CG Employees. He continue to take a leading role in the Pensioners movement in his capacity as the Secretary General of both BCPC and NCCPA.

Thus it can be seen that as a leader who entered the Government Service in the 1stCPC pay scales, played his due role in shaping the destiny of pay scales of all CG Employees from 2nd CPC to 7th CPC, has no parallel at all. His style of working even at the advanced age was amazing and inimitable. At a time when the entirety of CG Employees and Pensioners are looking forward to this leader for tasks connected with the 7th CPC, he is snatched away by the nature. This loss is irreparable, we feel orphaned. 

Mortal remains of Vyasji has been taken to his ancestral house jodhpur. Cremation would be at Jodhpur today. He is survived by his wife, two sons and two daughters and grandchildren and great grandchildren.

COMRADE S.K. VYAS NO MORE

 With deep grief and extreme sorrow, it is intimated that Com. S.K.Vyas, the legendary leader of the Central Govt. Employees and   Pensioners, is no more. He passed away at about 08.20 PM on 13 February 2015, at  a Jaipur hospital, where he was admitted a few days back after a massive heart attack. He was recovering, but all of a sudden, the situation worsened and he passed away.
He was 85 years.
His funeral will take place at Jodhpur on 14th Feb 2015. Com.Vyasji was the Secretary General of the Confederation of Central Govt. Employees and workers since 1967 for more than four decades. He was holding the posts of Secretary General of both BCPC and NCCPA, Federations of Pensioners Associations till his end.
His death is an irreparable loss to the entire CGE and Pensioners movement.
Our heartfelt condolences to the bereaved family, friends and comrades.

We remember Comrade N.J.Iyer

Today is the 15th death anniversary of Revolutionary Leader of the P and T and Central Employees movement, Comrade N.J.Iyer. He left us on 13th February 2000.
Com.Iyer’s life is completely intertwined with the P and T union movement since 1945, the year in which he joined the P and T Department. He was elected as the General Secretary of the All India RMS and MMS Employees Union Class III in the All India Conference of R-III Union held at Amritsar from 8-13 September 1963. He continued as the General Secretary till Jabalpur AIC held in 1985, when he voluntarily stepped down and handed over charge to Com.B.K.Banerjee as GS.
Com.Iyer was elected as the President of NFPTE in 1992 and continued as such.Com.Iyer was arrested and kept in custody during Emergency.
Iyer’s contribution in making the R III as a militant trade union is beyond words.
Iyer was a manifestation of how a true trade union leader should be. Simple living and high thinking was his life style. He never tolerated the reformist path and fought against it in the TU movement. After Com.KG Bose passed awayin 1974, it was Com.Iyer who led the P & T  trade union movement on the corret path. There are a lot of incidents of his high integrity and straight dealings with the workers and comrades.

Comrades,

            Staff Side PJCA meeting was held at NFPE Office, North Avenue Post Office Building, New Delhi-110 001 on 04th February,2015 under the Presidentship of Com. D. Theagarajan Secretary General FNPO. All General Secretaries of NFPE, FNPO and GDS Unions participated in the meeting.

            The following decisions were taken in the meeting:

1.         Formation of PJCA at all Circles:

            Reviewed the position of formation of Circle JCA. PJCA has been formed in some Circles and in some circles it is functioning well. The Circles in which the PJCA is not functioning, it should be formed by the respective CHQ leaders..All Circle Secretaries should also take it seriously and inform the CHQ and Federation after formation. This work should be completed before 15th February, 2015.

2.         Strategy was decided for the meeting to be held with Secretary Post at Dak Bhawan , New Delhi on 05.02.2015.


MEETING OF PJCA  LEADERS WITH SECRETARY POST

            Meeting of PJCA leaders was held with Secretary (Post) and other higher officers of Postal Board. Though Secretary (Post) gave positive assurances on most of the issues and also assured that Deptt. Is not going to implement recommendations of Task Force Committee report and there will be no corporatization and Privatization of Deptt. and before implementation of any new scheme it will be discussed with unions and after getting the consent of unions it will be implemented. Secretary (Post) also agreed to refer again the case of GDS wage revision and other service conditions to Government of India for inclusion in the 7th CPC. She also assured to finalize the Cadre restructuring proposal of all Cadres before 30th April-2015.

            Though Secretary (Post) has given many of the positive assurances but keeping in mind the style of functioning and political and economic policies of Central Government we cannot believe as they are implementing all Globlization   and privatization policies very intensively in all the sectors and mostly employees of all sectors are agitated and moving on path of agitation.

            Therefore, we appeal to all Leaders and entire rank and file to get ready for struggle and observe the following programme of action in a phased manner on 40 points Charter of Demand:

1,         Formation of JCA at all levels before 15th February, 2015.
2.         Dharna infront of Divisional Offices on 20th February, 2015.
3.         Dharna infront of Regional offices on 27th February, 2015.
4.         Dharna infront of Circle Offices on 2nd March, 2015.
5.         Dharna by all India Leaders at Directorate, New Delhi on 15th April, 2015.
